FAR 21 and FAR 43 changes

To all IA’s, 145 Repair Stations, and 135 Operators:

In order to assist you in complying with 14 Code of Federal Regulations (CFR), the Charleston FSDO is notifying you of recent changes to Parts 21 and 43.

14 CFR Section 21.120 now reads as follows:

"Responsibility of supplemental type certificate holders to provide written permission for alterations."

"A supplemental type certificate holder who allows a person to use the supplemental type certificate to alter an aircraft, aircraft engine, or propeller must provide that person with written permission acceptable to the FAA."

In addition, 14 CFR Section 43, Appendix B, Section B43.1 concerning FAA Form 337, Major Repair and Alteration, was changed to the following:

"(a)……each person performing a major repair or major alteration shall –"

"(3) Forward a copy of that form to the FAA Aircraft Registration Branch in Oklahoma City, Oklahoma, within 48 hours after the aircraft, airframe, aircraft engine, propeller, or appliance is approved for return to service."

There is no longer a requirement to forward a copy of the FAA Form 337 to the local Flight Standards District Office (FSDO).

The changes were effective on November 3, 2006.
